By accessing or using the Services provided by Zekara ("we", "our", or "us"), including the mobile game Yummy Gummy Match and our website, you agree to be bound by these Terms of Service ("Terms").

3. Eligibility

By using the Services, you represent and warrant that you meet these eligibility requirements. If you do not meet these requirements, you must not access or use our Services.

4. License to Use the Services

Subject to your compliance with these Terms, Zekara grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the game on a device you own or control
  • Access and use the Services for your personal, non-commercial purposes

This license does not include the right to sublicense, sell, resell, transfer, assign, or otherwise commercially exploit or make available to any third party the Services or any content therein.

5. Virtual Items and In-App Purchases

Our game may offer virtual currency, items, or other digital goods ("Virtual Items") that can be purchased with real money or earned through gameplay.

  • All purchases of Virtual Items are final and non-refundable, except as required by applicable law
  • Virtual Items have no real-world monetary value and cannot be exchanged for real money or goods
  • We reserve the right to modify, manage, control, or eliminate Virtual Items at any time
  • You do not own Virtual Items — you receive a limited license to use them within the Services

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material in our Services, except as follows:

  • Your computer may temporarily store copies of such materials incidental to your accessing and viewing those materials
  • You may store files that are automatically cached by your web browser for display enhancement purposes

8. User-Generated Content

If our Services allow you to post, share, or transmit content, you grant Zekara a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, adapt, publish, translate, and distribute that content in connection with providing and promoting the Services.

You represent and warrant that you own or have the necessary rights to share such content and that it does not violate any third-party rights or applicable laws.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

Zekara does not warrant that:

  • The Services will function uninterrupted, secure, or available at any particular time or location
  • Any errors or defects will be corrected
  • The Services are free of viruses or other harmful components
  • The results of using the Services will meet your requirements

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ZEKARA, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for any claims arising from or related to the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

12. Indemnification

You agree to defend, indemnify, and hold harmless Zekara and its affiliates, licensors, service providers, employees, agents, officers, and directors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Services.

13. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in Singapore, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

15. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 14 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised Terms.
